Terms of Service
1. Who we are
AI Generate (the “Service”) is operated by AI Marcus, an Estonian undertaking. Our public site is aimarcusimage.eu. By creating an account or using the Service in any way, you agree to these terms.
2. Account & eligibility
You must be at least 16 years old to create an account. One person, one account; you are responsible for the security of your password and API keys. Notify us immediately at hello@aimarcus.eu if you suspect a compromise.
3. The Service
AI Generate forwards your API calls to upstream model providers (OpenAI, Anthropic, Google, OpenRouter, Replicate, Black Forest Labs, ByteDance, Suno, ElevenLabs, and others) and bills you in pre-paid credits. We do not train models on your prompts or completions, and we do not retain prompt or response payloads beyond what is needed for billing reconciliation, abuse review, and operational debugging (typically 30 days, longer where the law requires).
Upstream providers have their own terms; by routing a request to a given model you also accept that provider’s rules for that call.
4. Acceptable Use
- No content that is illegal in Estonia or in the European Union.
- No CSAM, terrorism, doxxing, malware, or non-consensual sexual content; no impersonation of real people without their explicit consent.
- No deceptive synthetic media targeting elections, public officials, or financial markets.
- No abuse of the network: no unauthorised scraping, no resale of API keys, no probing for vulnerabilities. Report security issues at security@aimarcus.eu.
We may suspend or terminate accounts that violate this policy without notice when public safety, our infrastructure, or our partners are at risk.
5. Credits, billing & refunds
Credits are prepaid. Each API call deducts credits according to the published per-unit price for that model. Pricing is shown live at /pricing and synced daily from upstream providers; we may change prices with reasonable notice.
Unused credits do not expire while your account is active. We do not refund credits that have already been spent on completed model calls. We will refund unspent credits within 30 days of purchase on request, provided the underlying card payment has not been disputed elsewhere.
Failed model calls (HTTP 5xx upstream, internal error) are not charged. Polling task status does not consume credits. Spend caps in your dashboard return HTTP 402 once reached.
6. Ownership of generated content
You own the prompts you send and the outputs we return, subject to the upstream model provider’s licence. You are responsible for verifying that any output you publish does not infringe third-party copyrights, trademarks, or rights of publicity.
7. Service availability
We aim for high availability but we do not guarantee uninterrupted service. We deliver the Service “as is” without warranties of merchantability or fitness for a particular purpose. Maintenance windows, upstream provider outages, and security incidents may interrupt the Service.
8. Limitation of liability
To the fullest extent permitted by Estonian and EU law, our total liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill.
9. Termination
You may close your account at any time from Settings. We may close your account if you breach these terms, fail to pay, or use the Service in a way that endangers our infrastructure or partners. On closure we delete personal data subject to the Privacy Policy and statutory retention.
10. Governing law
These terms are governed by the laws of the Republic of Estonia. Disputes are resolved in the courts of Harju County, Estonia, except where mandatory consumer-protection rules grant you the right to your local courts.
11. Changes
We may update these terms. Material changes will be announced on the dashboard and by email at least 14 days before they take effect. Continued use after the effective date is your acceptance of the new terms.
